02 Rules of Origin for Preferential Goods

On April 03, 2018, the Ministry of Industry and Trade issued Circular 05/2018/TT-BCT regulating the origin of goods.

The origin of preferential goods must ensure the following 02 rules:

- For exported goods and imported goods eligible for preferential tariff and non-tariff policies, the preferential origin rules are implemented according to the International Treaty that Vietnam has signed or joined and according to the regulations of the Ministry of Industry and Trade guiding that International Treaty.- For exported goods eligible for the Generalized System of Preferences (GSP) and other unilateral preferences, the preferential origin rules are implemented according to the regulations of the importing country granting these preferences and according to the regulations of the Ministry of Industry and Trade guiding those origin rules.

Additionally, Circular 05 also stipulates the general principles for determining the origin of goods, specifically:

- Goods are determined to originate according to the provisions of Circular 05 from the country, group of countries, or territory where the final production process substantially changes the goods.
