Regime of Allowances for Officials Receiving Citizens

From February 01, 2017, the policies on allowances for individuals performing the tasks of receiving citizens, handling complaints, denunciations, petitions, and feedback at Citizen Reception Offices or Citizen Reception Locations are implemented according to the provisions of Circular 320/2016/TT-BTC.

Translation of Legal Document on Compensation Regime

The compensation regime under Circular 320 applies to the subjects stipulated in Article 21 of Decree 64/2014/ND-CP regarding the guidelines for the Law on Citizen Reception. Specifically::

- Group 1: Officials belonging to agencies, organizations, or units entrusted by the competent authority with the task or assigned to perform the task of citizen reception, handling complaints, denunciations, recommendations, and reflections at the Citizen Reception Office or citizen reception location.- Group 2: Heads and deputy heads of agencies, organizations, and units responsible for periodic or ad-hoc citizen reception; officials summoned by the competent authority to perform the tasks of citizen reception, handling complaints, denunciations, recommendations, and reflections at the Citizen Reception Office or citizen reception location.- Group 3: Officials; officers, non-commissioned officers, soldiers, professional servicemen, and defense employees in the armed forces; civil defense personnel, healthcare, and traffic when assigned or coordinated by the competent authority to participate in citizen reception, maintaining security, order, and ensuring healthcare at the Citizen Reception Office or citizen reception location.- Group 4: Heads and deputy heads of agencies, organizations, and units; officials assigned by the competent authority to be in charge of handling complaints, denunciations, recommendations, and reflections.

And within the scope of the following citizen reception offices and locations:

- Central Citizen Reception Office; citizen reception locations of Ministries, ministerial-level agencies, General Departments, and equivalent organizations; Departments; organizations under Ministries and ministerial-level agencies; Supreme People's Procuracy, Supreme People's Court, State Audit Office; Central Committee of the Vietnam Fatherland Front; central bodies of political-social organizations.- Provincial Citizen Reception Offices; citizen reception locations of specialized agencies under the provincial People's Committee; bodies under specialized agencies of the provincial People's Committee; provincial-level People's Procuracies, provincial-level People's Courts; provincial-level Vietnam Fatherland Front Committees; provincial bodies of political-social organizations.- District-level Citizen Reception Offices; citizen reception locations of specialized agencies under the district-level People's Committee, district-level People's Procuracies, district-level People's Courts; district-level Vietnam Fatherland Front Committees and bodies of political-social organizations at the district level.- Communal Citizen Reception Locations.- Citizen reception locations at agencies under the Government of Vietnam, units under government agencies; public service providers.

According to Circular 320, compensation policies for the above subjects are calculated per working day. Specifically:

- Subjects in Group 1 and Group 2 who do not receive professional responsibility allowances, when performing tasks of citizen reception, handling complaints, denunciations, recommendations, and reflections at the citizen reception office or location are compensated with VND 100,000/day/person; in case of receiving professional responsibility allowances, they are compensated with VND 80,000/day/person.- For officials assigned by the competent authority to perform citizen reception tasks, handling complaints, denunciations, recommendations, and reflections at the Central Citizen Reception Office, compensation is VND 150,000/day/person; in case of receiving professional allowances, they are compensated with VND 120,000/day/person.- Subjects in Group 3 and Group 4 are compensated with VND 50,000/day/person.

Compensation for those performing tasks of citizen reception, handling complaints, denunciations, recommendations, and reflections is paid together with the monthly salary and is not used for calculating social insurance benefits and health insurance benefits.

Circular 320/2016/TT-BTC takes effect from February 1, 2017, and applies to the 2017 budget year, replacing Joint Circular No. 46/2012/TTLT-BTC-TTCP.
